In August 2023, Sean and his legal counsel won a ground breaking decision at the Employment Tribunal as part of Sean’s ongoing legal battle with his former employer ACAS.
You probably haven’t heard of Sean Corby, but everyone should know his name as he scored a huge victory for Free Speech.
After he had relunctantly posted comments on his staff intranet which challenged what he saw as the divisive racial politics of Critical Race Theory, some of his colleagues vilified him, and his employer asked him to delete his contributions. Sean refused, on principle, and was fired.
Corby had argued that a better approach to addressing racism was to follow the ideas of Martin Luther King, who said that people should be judged by the content of their character rather than the colour of their skin.
In a ground-breaking judgment against workplace cancel culture and for lawful freedom of expression, the Employment Tribunal ruled that Corby was expressing a legitimate philosophical belief when he challenged Critical Race Theory in his workplace. As such, his belief amounted to a characteristic that will now be afforded protection by Section 10 of the Equality Act 2010.
